Description of Design Search

The mark consists of a three-dimensional configuration of the trade dress of a cafeteria, restaurant, bar and cafe services establishment frontal view or storefront. The storefront features cladding and moldings creating the shape of two rectangles at the top, closer to the ceiling and one at the bottom closer to the floor on the right hand side. The rectangle on the left features the wording "VASALISSA" in stylized letters, below the wording "CHOCOLATIER" appears in stylized letters. Between the top and bottom moldings on the right side, a glass rectangular window panel featuring a crown-style molding on top appears. The glass panel shows three sets of diagonal lines are drawn to represent the transparency of the glass. The items that can be seen through the glass are represented in dotted-lines as they are not claimed as a feature of the mark and only represent that the customers will be able to see the inside of the store from the outside; except for the part of the entrance door that can be seen through the glass. Below the rectangle on the left, the entrance door appears as an open double door. The doors are in the shape of a rectangle featuring a small crown-style molding on top of a glass rectangular window panel. The glass panel shows two sets of diagonal lines are drawn to represent the transparency of the glass. Each door also features below the glass panel moldings creating the shape of a rectangle. The door on the right is identical though it can only be seen partially through the right glass panel, as it appears open. Through the open double doors various elements can be seen. At the top of the back wall on the lift hand side the wording "VASALISSA" in stylized letters, below the wording "CHOCOLATIER" appears in stylized letters. In the center of the store a three-tier rectangular display table with the following dimensions: 2.50 meters long by 1.20 meters wide, approximately. The remaining of the items shown, such as decorations, chandeliers, chocolate products and shelving appear in dotted lines as they as not claimed as a feature of the trade dress/mark only to show demonstrate a clear depiction and the placement of the claimed elements of the mark.
