Description of Design Search

The mark consists of a three-dimensional trade dress of a makeup color wheel. The wheel is circular in shape and one side of the wheel is divided into twelve pie-shaped sections radiating from the center of the wheel. Each pie-shaped section is divided by white lines into five sections each containing a different shade of the skin color described in the outermost color band of each of the respective twelve pie-shaped sections, each of which is a shade of orange, peach, or tan. The twelve pie-shaped section colors listed in the outer band of each respective pie-shaped section correspond to the actual color located in the innermost sections and are identified as follows: orange, orange-yellow, yellow, yellow-green, green, green-blue, blue, blue-violet, violet, violet-red, red, and red-orange. In the center of the wheel is a white circle containing a partial outline of a woman's face to the right of the term "TERRI" which is above the terms "TOMLINSON" above "MAKEUP TRAINING ACADEMY" all of which appears in blue. The placement of the various colors located on the makeup color wheel are considered to be part of the overall mark.
