The mark consists of a three-dimensional product design and packaging for art kits featuring the distinctive and non-functional placement of the canvas, paint pots and paint brush in a manner that complements the colors of the background design on the canvas and that highlights the contents of the product. The window cut-outs in the outer packaging allow for a peek-a-boo look at the internal kit components. The canvas, paint pots, and brush are revealed by these die-cut windows, without using plastic to reveal these components. The full-color insert component of the packaging gives the consumer a color-accurate "before-and-after" view of what their finished painted canvas will look like. The accent color of mint green (Pantone 565 C) in the packaging is inherently distinctive when used in combination with the aforementioned three-dimensional design.
