Description of Design Search

The mark consists of trade dress for the appearance and design of the interior of a wine bar evoking a warm, rustic, industrial feel with its signature blend of reclaimed wood and industrial steel grey accents. The wooden wine rack is the centerpiece of the bar featuring a large dark walnut brown wooden cubbyhole-style shelving with a built-in white wooden cabinet at the bottom center with chicken coup wire front. The wooden wine rack is adjacent to hand stained dark walnut brown cabinet with rows of clear wine glasses on display. The bar itself is made of thick rustic reclaimed wood as the counter top with white panels at the front lined with wooden bar stools with industrial steel elements. Within the bar, bell shaped clear glass light fixtures with industrial-look light bulbs traverse the length of the bar and the main seating area. One main wall of the bar is covered with horizontal panels of aged reclaimed wood stacked together creating a warm rustic atmosphere. The tables are also hand made of pieces of reclaimed wood with industrial steel fixtures on the feet. Tables lined against the wall have a bench on the perimeter with adjacent industrial steel chairs with antique finish. The legs of the benches, tables, stools and bar have industrial steel accents. The tables are lined with miniature mason jars wrapped in burlap. The remaining walls have large wooden chalkboards with handwritten chalk signage including a hand drawn map. One large painting is featured by the entrance of the bar. The solid lines show the positioning of the mark in connection with the wine bar and those features claimed by the applicant as its mark. The materials, colors and placement of the various items are considered to be part of the overall mark.
