Description of Design Search

The mark consists of a product packaging design affixed to a three dimensional bottle shown in multiple angles. When viewed from the front, the bottom has a circular indentation towards the bottom left. A seal comprised of a central circle and concentric three rings with the central circle containing a stylized image of the bust of William Ewart Gladstone holding an axe and positioned with his body slightly facing to the viewer's left and with his head turned slightly towards the viewer's right appears on the front of the bottle. Towards his left shoulder appears a heraldic crest comprised of the design of a stylized winged griffin shown in profile and facing to its left with its tail is depicted pointed backwards and holding a sword in its right talon. Above the griffin design appears a banner with the wording "FIDE ET VIRTUTE" in capital letters and a stylized font. Below the griffin design appears the wording "W.E. Gladstone" in a stylized script font. The thin inner most ring surrounding the circle is slightly enlarged towards the bottom and contains the words "WILLIAM GLADSTONE. PRIME MINISTER AND HIS AXE" in small stylized capital letters below the bust design. The thick middle ring is divided into two banners which follow the curves of the upper half and lower half of the ring. The banner in the upper half includes the wording "THE GLADSTONE AXE" which appear in an upward curve in capital letters and a stylized font. The lower banner includes the words "THE BLACK AXE" in a downward curve in capital letters and a stylized font. The design elements separating the banners found on the left and right side of the middle ring feature the depiction of axes with the heads facing towards the center circle. Curved triangles pointing outward appear in the space between the banners. A rectangular label in the shape of an axe handle appears under the seal with the wording "SMOOTH & RICH BLENDED MALT SCOTCH WHISKY", "INSPIRED BY THE RT. HON. W.E. GLADSTONE", "750ML", "43% ALC/VOL", ""NOT A DROP OF MY BLOOD IS NOT SCOTTISH"", "W.E. GLADSTONE" ""TRIED-TRUSTED-TRUE"". The left side of the bottle has an embossing comprised of the partial design of a tree with branches and limbs shown towards its left, some of which limbs are depicted as chopped. Below the branches appears a depiction of William Ewart Gladstone in three quarter profile holding the heel of an axe with the head resting on the grass below in his right hand. When viewed from the top, the front portion of the shoulder of the bottle contains the embossed wording "GLADSTONE AXE", in stylized font, above the embossed wording "SCOTCH WHISKY" all in capital letters and a stylized font and the back portion contains the embossed wording "1868. 1880. 1886. 1892" in stylized font. The back portion of the shoulder of the bottle includes the literal element, embossed in stylized font, "1868. 1880. 1886. 1892". A label in the shape of an axe blade appears on the back of the bottle. The bottom of the bottle has an embossing of the letters "W", "E", and "G" in a highly stylized font superimposed upon one another with the arms of letter "W" creating the outermost border and the letter "E" at the center. The outer curve and the bar of the letter "G" intersect with the inner strokes of the letter "W". The contours of the bottle shown in dotted lines are not claimed as part of the mark but are depicted to show the placement of the mark on the goods.
