electronically filing the Section 8 Affadavit

Posted by . updated on 11/11/2009
I am electronically filing the Section 8 Affadavit (Declaration of Use of Mark in Commerce Under Section , since it has been 5 years since my trademark was registered. What I have is a service mark, which consists simply of the name of my web site, including the .com. There is no artwork or logo; the original registration simply had a typed drawing which was the name spelled out and nothing else.

Where I am stuck on the Section 8 Declaration form is at the Specimen Image File. What do they want here? Do they want simply another black-and-white typed drawing consisting of just the name typed out? Or do they want an example of the service mark in use, i.e., a screen shot of my web site, or what?

What sort of image should I submit and what exactly should I type in to the next box, "Describe what the specimen submitted consists of:"

Thank you for your help!

That's exactly what they are looking for.  Be sure your use qualifies as a "use in commerce".

I'm not sure what you're asking in the first part of the quoted language, but as for the description box, describe what you're submitting, e.g., "website advertising services" or "website constituting point of sale materials," as appropriate.

Im new to trademark law but have read through www.uspto.com to ask, i would hope, an intelligent question to the forum.

I have a few questions.  My company is a one person LLC that will provide quality assurance consulting services.  My company name is XXX Consulting, LLC.  "XXX" will represent my companies true name.

I did a search on the USPTO database, using XXX.  I looked through all the...

Hello, I was in process of trying to register a business name that I am starting and somehow I just noticed it has me under "Service Mark" rather than a "Trademark". I am worried if that will become an issue later? I will be a retail florist. It is now filed under 1B so should I have it changed right now? If so, what is the process of doing this? Or should I wait and see if I do get it approved and when I later start my business, and change it into a 1A basis, I can reques...

I just joined a small investment firm and discovered that they have never filed for a trademark on their name (they've been in business over 15 years).

I want to handle this myself rather than hire an attorney (I'm a lawyer but this is not my specialty by any means), but I've got some questions that I'd like to get some feedback on.

Let's say the name of the firm is "Acme," and Acme is a real name (not a made up one like Accenture or so...
