Hello,  I have been infringed against.  The infringer used the name of my company (registered) on the exact same goods.  I have read that the owner of a mark can obtain the profits such infringer made from use of the mark.  Is this true and what are the circumstances which allowor it?

There is a company which is using my mark on the exact goods as I am.  This company has prospered to a large extent in a market which is highly competetive, so it  would be benefitial to me to have this company license the mark (with help from an attorney).  To encourage such arrangement, would it be wise or effective to offer a license to one or more of their competitors, like a "free agent"?

Our unique business name is trademarked, registered in the USPTO for several years.  A British firm in a similar, but not identical, line of business has started using this as the name of their product.

Hello-

We never in a million years expected someone to steal the name of our product.  When they registered their website, they had to see we already had the name taken and they went ahead to started marketing their product with our name anyway!  There's is a bad product and is ruining our good name.

Further to that they advertise our website URL and when you click it, it takes you to there website.  Worse than that, the company doesn't officially exist except on ...
