Hello,

Should I trademark just the graphic part of my logo, or trademark the graphic part of the logo with my business name in it as well?

Or would I have to have two different trademarks; one for the graphic, and the other for the business name?

I'm starting a new e-commerce retail business next year and I had a few questions in regards to trademarking a name.

I was involved in US Federal fraud lawsuit with a public figure. It was dismissed. Since then, the public figure has trademarked his first and last name together "First Last". I'm currently developing an online game, that has been in planning for almost a year.  I have the registered .com/.net.  The (possible) problem is that someone has been running a game with a similar name for a few years now (I didn't know about it).  It has the same name as my game, except the domain has a "-" in between the syllables of the game's name.

Hello,

I am a singer and am about to put out my first album.. I have been toying with using my middle name - "KARUNA" as the name to go by for this album.

But I've looked up the trademark and have found a "Karuna" copywritten under selling music, cd's, etc.. I believe it's a small record label, but it seems like it might conflict. Does this matter when it's my LEGAL name? Can I still use considering it IS my name?

I'm starting a small clothing company and have been selling items for the last 3 months.  I've been calling my company a single word name - lets call it "Widget"

Today I saw that another clothing company is in the final stages of registering "Widget Wear" with the USPTO.  What are my chances of still registering and using the "Widget" mark?  Will I be seen as infringing "Widget Wear"?  Does a trademark on a 2-word phrase also ...

Thinking of making a famous quote my company tagline. It is only famous to those in my profession.

Any barriers to trademarking?

If I choose not to trademark it and use it anyway, any potential problems?

The author of the quote is dead and my industry is small and snobby so once I use it, no one else will be "caught dead" copying me....

I have a small business that sells personalized pet collars. ?A competitor of mine has trademarked a composite which includes the wording "personalized pet collars". ?Their attorney has sent me a letter saying that I cannot use this phrase. ?At what extent can I use the phrase "personalized pet collars" in my marketing as this describes the product I sell?

I belong to another forum and they have just received a cease and desist. The forum I belong to discusses things in specific job fields and we all give eachother information on different topics.

My question is this, if a website name has the word 'forum' at the end, can those websites actually own the rights to those specific names (ArtForum, LawForum, BookForum, EventForum etc.) and not allow any other forum to be called 'forum' or use those words to describe what the forum is for?

I'm starting a small magazine and, though it's expensive, going to pursue trademarking the name. That said, my understanding is that one can also (and possibly should) trademark the entire banner--that is, the distinctive printed title of the publication as it appears on the copy.

My question is the relationship of fonts to trademarking a banner. Fonts are protected content--how can I make sure I've secured proper rights to a font to trademark a banner in said font?

We have a generic name custom kit and a company who have a trademarked name Kustom Kit, want to take our name off us, can this happen?

We think they could not trademark the generic Custom Kit, but chose Kustom Kit instead, now they say we are trading using their trademark , our company name is PSL custom kit. anybody advise.  Our URL is customkit dot com

i just finished my eBook and would like to name it "title A".

i just realized that another person in my niche/market has an eBook by the same title, but its not trademarked.

would i be in any legal trouble by using that title for my eBook?

if so, could i trademark it to avoid problems?

I am looking to trademark the name of a clothing apparel line called Sport. I have done a search and have found possible confliting clothing lines that say Peace Love Sport, I Love Sport, and Sport=Life.

First, will I have a hard time registering my apparel, Sport, since it is already used in other tradmarked names?  

Second, if my chances are slim, would it help if I were to change my apparel line to  Sport Clothing Company?

I have a question about trademark infringement.  Let's say there is a children's book whose title is comprised of only common words, or a common phrase, such as "One If By Land", as an example.  If I published a children's boardgame with the same name (but which has nothing at all to do with the book), is that infringement, or is it not, since it's very common words, and since it's an unrelated game, and not a book.  Thanks in advance.

I'm not an attorney by any means, therefore some of the wording gets confusing on the USPTO's website.  I'm aware you can submit a trademark that has not yet been used in the market, however how long do you have to complete the file, is there a deadline?  What information is needed from you to file, specimen?
