I have searched the Federal database and found that a shop name I am currently using is not trademarked, however, I have been contacted by an attorney stating that I am committing trademark infringement by using one word in my two-word shop title (their client's shop name is also two words)... they say that it will be confusing to their customers, even though we do not sell the same items at all.  I can't believe that this is accurate since there are 10 active trademarks contai...

I started some blogs to register a copyright for a book title, but found out that titles cannot be copyrighted, only trademarked. So now I published various variation of the book title:

I am on the board of an non profit organization that will have a dinner of foraged foods (mushrooms, nettles, etc.) and wants to call it "Where the Wild Things Are." I know that in general book titles are not protected by trademark, but using Maurice Sendak's title seems somehow wrong to me. Does anyone know what the law or ethical standards regarding this is? I'm starting a small magazine and, though it's expensive, going to pursue trademarking the name. That said, my understanding is that one can also (and possibly should) trademark the entire banner--that is, the distinctive printed title of the publication as it appears on the copy.

My question is the relationship of fonts to trademarking a banner. Fonts are protected content--how can I make sure I've secured proper rights to a font to trademark a banner in said font?

i want to write a eBook for my niche, but im kind of concerned when it comes to the eBook title

i already have a name picked out, lets say for an example, the title is

"The Gurus Guide"

lets say that theres another book on the same niche with the title "The Guru's Guide" where the guys internet alias is "The Guru"

would i be in any legal trouble if i named the eBook "The Gurus Guide"?

i just finished my eBook and would like to name it "title A".

i just realized that another person in my niche/market has an eBook by the same title, but its not trademarked.

would i be in any legal trouble by using that title for my eBook?

if so, could i trademark it to avoid problems?

so I filed a mark, and I am have my last office action.   I am curious, can I change the ownership of my mark from my LLC to me?   I am the only one in my LLC.   Does it cost anything?  Can anyone provide a link?

I just spent a lot of money purchasing a domain name that I want to use for my company name and brand.  While doing a google search I noticed that the same name is the title of a book currently avaliable.  Will I be able to trademark that name for my business?

Hi, I've just completed the first draft of a novel.  

But in checking out the domain name, I found the title I want to use--a fairly obscure and invented word--is registered with a dot-com ending, and further investigation on the government databases revealed that my title is also trademarked--by a large movie studio.  Generally speaking I'd say both uses are entertainment industry uses, so I'm a bit concerned.

I am getting ready to print up my first children's developmental video in a series. I have trademarked my company's name recently, Smarty Rabbit.  As the company is just starting out I am low on funds and do not want to drop another 300 bucks to trademark the title of the video though. I am planning on having a live concert and titling it "Hawaii Calls." There was a radio program with that title and I am aware that the name "Hawaii Calls" may be trade or service marked. I remembered something about a title not being able to be copyrighted, can a trade or service mark prohibit the name from being used as a title?

I am getting ready to start a video podcast.  Now, I have purchased a DNS for the .com name that will host the podcast.  I am unsure, if I need to trademark the podcast's logo and name, though.  Please someone help me with this.  I am new to this trademark business, but want to make sure I have covered all my bases before I release the podcast.

If I were going to make an instructinal book or video about eBay, and wanted to call it "Making extra money from garage sales to eBay" (or any other title with the word eBay in it), is there any issue with the fact that someone owns a trademark on the word eBay?  I'm not talking about using their stylized logo, just the word eBay.  The book would in fact talk about eBay and other profit making endeavors, would actually promote eBay to some extent, and so on.
