I know the remedies available to me when someone impersonates my domain name, content, website URL, etc.

My question is whether the same, similar or analogous causes of action exist when that someone also impersonates me by registering my personal name and domain name with the email providers, too? For example, [my domain name] @ gmail, yahoo, etc.

Someone I know used the name of a fairly well-know celeb as a user name on community site.  The user name displays as part of the URL.  This is a non-commercial site and the person that created it is just using it to interact with friends.

While he has not been "told" to abandon the account, he has been contacted and asked if he would be willing to give it up so that an entertainment firm connected with the celeb could use it.

What if a current trademark exists for a company and their name is similar to mine and the industry (category) is the same?

For example (I have used FICTIONAL names for sake of example):

If their company name is New York Publishing Group and my name is York Publishing, Inc.  and their trademark has the following:

My understanding is that common law TM extends to the geographic location where the TM is used and where it is likely to extend.

What about an unregistered TM used on products sold on a website?  The site is accessed from anywhere.  Does that mean that the Common Law TM extends across the US even though it is not federally registered?  And if so, what would be the point of federally trademarking if you could protect your TM simply by using it on the internet and obtaini...

Wanting to start a website/forum and print t-shirts under the name like "speak up" (not the actual name, just using it as an example), but let's say there was already a blog/forum online that uses that name to discuss gay issues (that would be one of the many issues we discuss), and they have a picture of a t-shirt with that name on it on their site. does that mean we can't do either the site or the t-shirt with that name?

Can a sports news website that provides NFL schedules, scores, and standings display team logos without the consent of each team?  

I understand that the information listed (ie: scores, schedules, etc.) is public knowledge and that you can not profit from the use of a trademarked logo.

Here's some possibly relevant information:
* The logos are not used to advertise the site.
* No merchandise is made or sold.

I'm helping a friend who lives in a small town set up a website which highlights and reviews most of the local businesses in town. He has photos of the store-fronts and I'm now wondering as to whether the appearance of the trademarks would be a 'violation' of some sort.

For instance- He's got a review of a local owned hardware store and one for Ace Hardware (with the logo visible).

Anyone know the field code to search for a particular NOA date in the Free Form (advanced) functionality of the TESS online search facility? (ie: [FD] = Filing Date, [RD] = Registration Date.  It seems weird that there appears to be no way to search on a date as significant as the NOA date) Anyone have any insight?

Hello,

I am planning to register a site which has got a suffix dbase.

Now I am in a fix as to whether the word dbase is a trademark. THere exisit a site called www.dbase.com , but I am unaware if this word is a trademark.

I have applied for a trademark for a tagline that I want to use in my business. The tagline did not turn up in a search of the USPTO database; nor did I find it while googling around once or twice.

Well, today, I googled some more (after having submitted my USPTO application for the trademark), and I discovered that the same tagline is being used by an Indian company that produces the same class of goods (although I don't believe they produce the same products my company produces).
