I have been doing product development for a new cosmetics line that I am starting and have invested quite a big of my own money. Now I just found out that there is another cosmetics brand that has been in business for a couple years with a name similar to mine. Well the person who was going selling me the alternative domain I was interested in has rather rudely disappeared off the face of the planet, so I am just going to go ahead with the potentially similar name. Thank you both for the replies, though I must admit I am just as confused as I was to begin with .

We sell a product called instant door from our web site instant-door for the last 5 years ..We have not registered at the USPTO. I would appreciate any thoughts and opinions on my post.

First, is it possible and what general cost might it be to sit down with an IP attorney to review a case with me. I take my created materials in for review and the competitors materials and have the attorney provide me with their expert advice as to whether I?m infringing on someone rights.

I recently received an office action refusing to register the mark under the section 2(d) - likelihood of confusion.

Details ?
Mine is intent to use application for a mark ? ?BUTT? for G&S ? Bed sheet and pillow cases in Class 024.

The mark was refused as there was another mark registered under BUT (without the extra T) for Bedding, namely ? Mattresses, Box springs in Class 020.

The Foreign meaning of BUT and BUTT both means Sleep.

Hi,

I have a question on confusingly similar names. My product is eg called 'Peek Holidays'. My competitor's product is called 'Peak 1 Holidays'. Another example: 'Looze Gels' and 'Loose 2 Gels'

The names are a suggestive mark with a hint of what the product is (eg COPPERTONE for sun tan lotion, PENGUIN for coolers or refrigerators)

Hello,

The name of my company is EXRN, Inc.  I am in the process of designing a rough draft of a logo.

I would like to do a large capital "E" with a smaller "X" next to it to make an arrow like FedEx does.  The difference is that I would color in the arrow.  The "RN" would then sit on top of the "x" and the word incorporated with be along the bottom of the whole thing.

Since the E and X is close to the FedEx log...

Today I received a C+D letter from a company who claims I am infrigting on their trademark. ?My company sells similar web services as they do. ?I registered my company in 2005, the patent they provided shows they registered the service mark in 2003.

They are claiming that the use of my company name is confusingly similar to theirs.

Our company's name is similar but not identical to theirs. ?For example, I will make up an example below...

Does CadTree infringe on company CadKey? The first word denotes the generic industry specialization.  Phonetically they are similar because they share the first word and rythme the second.  Both sell similar products (may directly compete. Mostly web based)

I have been running a business since early january 2006.  I never thought to get a trademark until recently when a company offering the same service I do used my company name (only backwards and different plurals) ( random example: chefsalads and saladchefs).

I own a company which was incorporate last yr. At the time, I also trademarked the company name (Valens Wellness) for sale of my proprietary nutraceutical products.
