I registered a domain name I am planning on building a website using the domain I purchased. I did a search on the domain and found that the name has a trademark Abandonment Date - two things: 1) Can I trademark this name since it currently is showing an abandoment date. 2)Since I have registered the dot com succesfully a few years back, will this cause any conflicts with the dot org and dot net registrants such as trademark and patent

Trademark License & Patent Number Agreements

In Trademark Ownership    -  updated on 11/11/2009
We have a trademark license and patent number agreement that we send to our customers. The question is whether this agreement is necessary. What does an agreement like this give us that the PTO doesn't, when we register our trademarks and patents? What are the benefits of having this type of agreement? Does it give us any more control over the patent or mark? Thank for your help.
Copyright, Patent, or Trademark?

Copyright, Patent, or Trademark?

In Copyright vs. Trademark    -  updated on 11/11/2009
I have created an idea for a product that I intend on having produced. The product is based on a short (four word) phrase and the four letter acronym based on the phrase. The acronym is going to be placed on a bracelet. I have also considered T-shirts, key chains, and other products. To own the phrase and acronym, should I file a copyright, patent, or trademark? If applicable, what type should I file? I am concerned about filling the proper forms and price (State vs. National?)

trademark/patent ? Easiest way to assert IP rights

Hi,

Our small firm has a problem.

We have a patented moderately successful product and a web based
competitor determined to infringe on our patent.  It is laughably
obvious.  So much so that all the major internet resellers refuse to
carry his copy.

More, the infringer only takes $ through p*y**l, but they refuse to
consider patent infringement as a violation of their acceptable use
policy and will not pull the plug on his activity. Go figure.

In Trademark Disputes    -  updated on 11/11/2009
Hi?

My story is this:

I currently hold several design patents for different products. Several weeks ago, I got a letter from an individual saying that my design patents were invalid and infringing on his designs. He requested that I stop producing these items and further asked me to relinquish my design patents over to him. The individual?s argument was that my designs were invalid on the sole basis of the individual having prior use of the design before I did. There was no ment...

Well, here' we go again. I've run across another trademark that is leading to an eternal patent.

US Serial No: 78526361.  Take a look.
Now let's take a look at a very old patent, serial number 2089171  from way back in the 1930's. You can see it here: http://www.pat2pdf.org/patents/pat2089171.pdf

In 1954 or thereabouts, a company invented something.  I'm only assuming patents were filed for it, and they would have run out long, long ago.
In 2002, they filed a trademark which is, like another trademark, essentially acting an an infinite patent.  This one even moreso than the other.  Not only would it stop us from making similar product, it stops us from making the product period
A friend recently got a letter from the company stating he'...
