Trademarking a Logo

Trademarking a Logo

In Logos    -  updated on 11/11/2009
Hello,

Should I trademark just the graphic part of my logo, or trademark the graphic part of the logo with my business name in it as well?

Or would I have to have two different trademarks; one for the graphic, and the other for the business name?

Thank you.

I have attached a picture that gives a basic outline of my logo and what I'm talking about.

Thanks,

Use of European CE logo, as Company Trade mark

Use of European CE logo, as Company Trade mark

In International Trademarks    -  updated on 11/11/2009
I want to use the European CE logo as the trade mark of my company.
My business name is something like "Cats & Elephants" thats why i want to use it, as these are the first initials of the company name.
I have no intentions of exporting my products out of country.

If i am not allowed , can i use the logo by having some slight changes in it, for example drawing a round border around the CE Logo or anything like that ?

Any help is appreciated.

2 Companies. 2 Logos. Trademark Violation?

In Trademark Disputes    -  updated on 11/11/2009
Company A and Company B are in similar industries.
Company A is based in MD, Company B is based in CA.

Does the similarity of their logo constitute any violation, copyright or trademark, for the second company to adopt this style of a logo?

Does it matter that the font for at least one of the logos is simply a slight modification (stretched) of a popular font on nearly every computer? Just as popular as Times New Roman here.

i have a new design company in the UK which is called Studio 66. I would like to use the logo (shield) that Route 66 (car navigation company) has but have my details within the shield?

IS this possible? I cant see a problem since the shield itself is used on highways in the USA probably before Route 66 trademarked it?

I may be wrong, so please if you could help, then let me know

company logo and name securing????

In Logos    -  updated on 11/11/2009
My friend came up with a logo which is a character not a name, and came up with a company name. example like Nike and there swoosh, both present at the same time. This is for a possible T-shirt company. Before he starts business he wanted to wear and get a feel for some of the shirts he might produce before selling them and getting a business license. Whats the minimal he would have to do? copyright? Patent? or Trademark? or all the above. From what I have read on the net it depends on if the...
Word Mark vs Logo registration

Word Mark vs Logo registration

In Logos    -  updated on 11/11/2009
Hello,

What do experts recommend: is it better to register a simple word mark without illustration, or full logo with complete design solution?

In the first case you can leave space for an eventual logo change, and in second case you protect your specific logo design solution.

Hope you understand what i want to ask..!

Thanks

In Branding    -  updated on 11/11/2009
I have a new online store for the sale of Auto Parts that I manufacture and to make navigation easier I would like to use the logo of the actual vehicle manufacture as the button so the site looks better.   For example if they wanted to look for parts for their ford they would click on a ford logo, etc.

Here is what I currently have at the bottom of all my webpages.

It's obviously illegal to reproduce someones image and or trademark, but I am wondering if it's ok to do an original painting of someone such as a professional athlete and the team logo they are associated with, and then sell it or at least try to as an original painting?

Is this original painting considered a reproduction even though it's the only one in existence?

Are there any exceptions? for example why can cartoonists create cartoons with sports, poli...

I'm starting a dog tshirt business and I've been told I would breach copyright on a few of my logos. But then I was also told that if you change a logo by 10% it doesn't matter you've slipped under copyright.

these are the pictures.

Are there any considerations one should take, other than those similar for a word mark, when applying for a Logo only mark?

Side Note:  I wish searching logo only registered marks was more user friendly.  Anyone have any tips (Jeff?)

I own an embroidery company that is growing. My customers are asking for brand name logos to be embroidered on their apparel. What is the law concerning this? I assume I need to obtain a license from the trademark holder. Is licensing required to embroider logos and if so, how would I go about doing this?

In Copyright vs. Trademark    -  updated on 11/11/2009

I was curious as to the line between a stylized trademark and a visual art work.  Assume in this hypo that a client is using the mark on goods, it is a trademark with a very intricate and original design.  Obviously, a TM is an order, however, would you register the design with the copyright office?  Maybe, because, why not, it is  cheap and you have additional protection.  Or as a matter of course, do those who register marks with design elements, r...

Use of Franchises Logo for use bt Franchisees

In Logos    -  updated on 11/11/2009
I am currently creating a website which will display logos and signs of franchises.

However I am wondering - though the franchisees have the right to use of the logos/signs can I display them online?

And if I can - will I have to make sure that only the franchisees see this information (over some type of secure connection) verify their account or can I let anyone of the public view general sign layouts and logos online.

Thanks for your help,

I have a quick question.  If your logo is original art and does not get registered, do you still have rights to that logo and can display it next to your company name without any recourse?  Wouldn't this be considered copyright art and cannot be touched?

For instance: if it is a logo you use to place on a shirt for clothing, on a size tag, can you still put that on it if you do not or cannot get it registered?

thanks

Can a sports news website that provides NFL schedules, scores, and standings display team logos without the consent of each team?

I understand that the information listed (ie: scores, schedules, etc.) is public knowledge and that you can not profit from the use of a trademarked logo.

Here's some possibly relevant information:
* The logos are not used to advertise the site.
* No merchandise is made or sold.
* The site clearly states that it is not affiliated with...

Logo vs. Text ? Multiple classes?

Greetings. Thanks to all the forum members -- it's been a great read.

My new company (less than 1 yr on sale) is ready to tm our brand name. I am a little unclear about classes and the purpose of multiple classes.

We sell cosmetic products, and our brand name is two words, "BRANDNAME MAKEUP". It is my understanding based on my readings, that if I register "BRANDNAME MAKEUP", then other makeup companies can not use this brand name. So far so good?
