International Trademark Infringement / IP rights?

In International Trademarks    -  updated on 11/11/2009
I launched a website about a year ago selling one single product (for exemple: photo books).
A bigger company located in the UK sent me a letter (from the CEO, no attorneys yet) stating that they own the Intellectual Property rights of this product.
They have been in business many years before me and have partnerships with big US websites. They state owning the IP rights, Copyright, general goodwill, visual effect and use of the term "PhotoBooks". After checking, I do see ...

Can you Trademark 'your name' International?

In Can I Trademark it?    -  updated on 11/11/2009
Good Afternoon,

I have an umbrella corporation that owns subsidiary companies.  I went to trademark the name and another company with the same name beat me to the table by two months.  I'll just keep telling myself "Not getting what you want can sometimes be a stroke of good luck."

In any event, I am expanding to other parts of the country (U.S).  It's very possible in the future that I want to expand to other countries.

I want to use my last name...

How many international registrations?

We have a mark registered with the USPTO, and have submitted an application for the CTM (EU) registration. We will be offering our product internationally. In addition to the EU, I see China and India as both significant opportunities and risks of infringement and knock-offs.

What other international registrations should we consider? Would the additional cost and effort buy us any practical protection?

Does having US and EU registration have any influence in other jurisdictions?...

How can a midsize company protect their marks internationally since common law does not apply. It's very expensive to pay, register and monitor your mark in every country. So how do big companies like Apple, Google, Adobe, etc protect their marks all over the world? I can't imagine they registered all marks in every country.

I have owned the website MerhabaTurkey.com (and .org) for nearly 13 years now, after having taken it over from its previous owner who had it operating since about 1995. Today I received a letter from Shanghai, China telling me that a company (HUAXIA Company) there is registering "merhabaturkey.cn" and "merhabaturkey.com.cn" as well as "merhabaturkey.asia" domain names. Neither I, nor the previous owner have ever internationally trademarked the website address since - at the time - there w...

I have been researching International trademark applications and found reference to the Madrid protocol, this protocol includes 2 countries we are interested in filing with once I've finalized our submissions to the USPTO. The international trademark applications on this site are individualized, do you provide assistance in applying under the Madrid protocol? Hello, I'm based in The Netherlands and was wondering if I'm allowed to use the words 'car channel' as a description of my Youtube channel, since there seems to be a trademark for this name (http://www.trademarkia.com/car-channel-76231236.html). But what if I don't use it as a name? These words are very general, so I should be okay using them right? Thanks for your advice! Gijs
