Hi,

I'm a wholesaler and have been selling for several months a specific toy with a specific name.
Recently, I was contacted by a company that bought the trade mark for that name related to that toy that I sell.
They said that now they own the trade mark for it and I can't sell it.
I was selling this product long before they even register the mark, can they prevent me from continue selling it now?
They also claim that they have patent pending rights for this product, but th...

Hi,

I am from Australia and i realize that most of you are in the U.S., but i am thinking the law maybe similar.

My question is, i own a business where people come to stay with me while travelling.  We bought the business 1 year ago and now wish to trademark our name.

I have done a search and our name is not trademarked in Australia, however there are two other accommodation providers within Australia who use the same name.  One of these was opera...

I have an idea for a t-shirt, which is sort of a name. It consists of a combination of letters and numbers. I did a search and it comes up as trademarked but for a different purpose.

Can I trademark my idea or name for use with t-shirts while this other trademark exists for an entirely different use?

Contest an existing trademark?

In Trademark Disputes    -  updated on 11/11/2009
What is the proceedure for contesting an existing trademark? I checked the uspto.gov web site and couldn't seem to find a form or info on the process. The only thing I could find was information a "Notice of Opposition" form, but that appears to be for a proposed trademark, not one that already exists.

Thanks

We own three Federally registered trademarks along with a host of corresponding domain names and business format IP in which several hundred thousand dollars had been invested to achieve its current level of development and use, and are now interested in finding a buyer to recoup some of that investment. Is there some type of agent or broker network that is available to assist us in finding a buyer and ultimately transferring the marks and IP? Thank you for your help.

Hi My question is best explained with a hypothetical example: Suppose there is a US company specialising in stock car racing who have registered the trademark "Mash Up" which is a particular version of their offering. They have registered the trademark in the US and EU/UK under category 28 for Toys. Their registration includes many examples of sub-categories for toys including board games. Now suppose I want to create a board game centered around mashing up potatoes which I want to c...

Trademark existing business name?

Trademark existing business name?

In Can I Trademark it?    -  updated on 2/21/2013
Myself and a friend started a business and put the business license in his name because it was cheaper to do so in the county he lives in. We have agreed to part ways, but disagree about who will continue with the business name. The only thing done in the business name is a business license, and a bank account. Could I trademark the name to continue using it? Thank you for any input

We would like to trademark our logo "TheFitBelt". Which is a running/fitness belt used for exercise (hiking, running, cycling or in the gym). Having done a search on USPTO trademark/TESS, we can see that there is a trade mark on "Fit-Belt". In essence only on the word "Fit-" as they cannot claim "belt". It was for a "weight lifting belt" so also comes under the category of "exercise". Having done a search on the internet, we cannot find this product or company anywhere. When looking further ...
