I am a 3D illustrator looking into self-publishing a book of 3D cutaway illustrations of various household devices. Would it be legal to include a 3D cutaway illustration of the Microsoft X-box (for example)?

Copyright, Patent, or Trademark?

In Copyright vs. Trademark    -  updated on 11/11/2009
I have created an idea for a product that I intend on having produced. The product is based on a short (four word) phrase and the four letter acronym based on the phrase. The acronym is going to be placed on a bracelet. I have also considered T-shirts, key chains, and other products. To own the phrase and acronym, should I file a copyright, patent, or trademark? If applicable, what type should I file? I am concerned about filling the proper forms and price (State vs. National?)

I'm really hoping someone can help me,

Company A: (A UK company) owns a fictional character that was sold to company B: (a US compnay) without compnay 'A''s consent. The US publisher kept the characters visual image but changed the name and registred the trademark however they subsequently went into liquidation, at the liquidation sale another US company bought the copyright (via an assignation but the US trademark had expired) from the bankruptcy auction.

Kudos on the board! I learned a lot reading through posts this evening but was unable to find a scenario closely related to mine. I'll try to make this as brief as possible and thanks to anybody who endures the entire sob story.

Allrighty, I'll just get right to the punch:

For the past few years I've been living off of a website for musicians that I designed from the ground-up. The name of the site is just a word I made up and you won't fi...

NBA/NFL Copyright Question

In Famous Marks    -  updated on 11/11/2009
Hi, I am wondering if it's legal to make a shirt that reads "Spurs" or "Pacers" or even "Bryant" without directing referencing the NBA.  Is the word "Spurs" copyrighted?

How about "SA SPURS"?

Last night on the Copyright forum I had left a post concerning my daughter's website using the name and photos of a deceased famous person.

My question now is:  Can quotes from a famous person be copyrighted or fall under "owning the trademark" of this person?  All this is very confusing.

If my daughter removed the photos (and quotes, if need be...

Business with logos worried about copyright!

I'm starting a dog tshirt business and I've been told I would breach copyright on a few of my logos. But then I was also told that if you change a logo by 10% it doesn't matter you've slipped under copyright.

these are the pictures.

Trademark or copyright infringement selling drawing of Coca-Cola bottle?

In Famous Marks    -  updated on 11/11/2009
Do I need to worry about trademark and/or copyright infringement if I was to sell copies of my grandfather's sketch of the contour Coca-Cola bottle. My grandfather designed the contour coca-cola bottle in 1915. The sketch which he drew, before producing the first prototypes, is in my possession and to this day has never been seen by the public. I would like to produce copies of the sketch and sell them, but I'm concerned that it might be infringing on the Coca-Cola Company's co...

Stylized/Logo Mark and Copyright

In Copyright vs. Trademark    -  updated on 11/11/2009
Group:

I was curious as to the line between a stylized trademark and a visual art work.  Assume in this hypo that a client is using the mark on goods, it is a trademark with a very intricate and original design.  Obviously, a TM is an order, however, would you register the design with the copyright office?  Maybe, because, why not, it is  cheap and you have additional protection.  Or as a matter of course, do those who register marks with design elements, r...

WebSite/T-Shirt Copyright/Trademark issue

In Can I Trademark it?    -  updated on 11/11/2009
Wanting to start a website/forum and print t-shirts under the name like "speak up" (not the actual name, just using it as an example), but let's say there was already a blog/forum online that uses that name to discuss gay issues (that would be one of the many issues we discuss), and they have a picture of a t-shirt with that name on it on their site. does that mean we can't do either the site or the t-shirt with that name?

Thanks for the help!

Someone copyrighted MY proper name, now what?

In Someone is copying my Trademark, what do I do?    -  updated on 11/11/2009
I have been using my first and middle name to identify my original clothing designs, which I've been selling for several years in boutiques.

Recently I found out that someone else is using MY name for a line of shoes. I checked the uspto.gov site, and they've registered the name for footwear. They write the two names as one word, with no spaces.  The listing indicates that, in their case, the name in the mark does not identify a living individual.

What can I do? I don't se...

URL copyright?

In Domain Names    -  updated on 11/11/2009
I recently acquired a domain with the acronym 'ncaa' in it.
I sent a quick email over to the ncaa asking if they felt that the url alone would constitute a copyright violation. I told them it would be used to discuss college athletics, but there would not be any use of any NCAA logos or trademark phrases in the actual site.

I received a letter stating basically that they did feel it would infringe upon NCAA property rights, and that they want me to transfer the domain over to them ...

For this question, consider the example of Cyberdyne Systems.

The Terminator series of films prominently feature a fictional robotics firm "Cyberdyne Systems" and real companies have since adopted the name.  Notably among them are an American special effects company and, more importantly, a Japanese robotics firm.

Do the copyright holders of the movie have any valid claim against the use of their fictional company name in real commerce?
Would such a claim be st...

I have been scouring the USPTO site to find another product like mine and I've yet to find one there or anywhere else on the web. However, it's just a matter of time before somone else comes up with this idea as it's a widely used but not yet marketed product. I've read so many things...the information has become jumbled in my fevered, overworked brain!

I am starting a online humourous tshirt line/store and it has jokes on the shirt and I was wondering if that can be copyrighted? If someone has the same joke as me, can I sue them for copyright infringement? Can I copyright them all at once or per joke? What if I just have a word(like a funny invented word) on a tshirt, can i sue someone if they have the same unique word on their tshirt? What if it's a regular word from a dictionary? However, I am also working on a product line that I would like to sell under this business name and logo. How am I to procede?
