In Can I Trademark it?    -  updated on 11/11/2009
I'm starting a new e-commerce retail business next year and I had a few questions in regards to trademarking a name.
My goal is to avoid any trademark infringements, like most of us here, and I'm afraid that the name I have in mind, might be a problem?
For example:
Say "Paper market" has been trademarked under USPTO by an another e-commerce shop and say my store name was going to be called "Paperlove" (without the space in between). Would it be O...

I have searched the Federal database and found that a shop name I am currently using is not trademarked, however, I have been contacted by an attorney stating that I am committing trademark infringement by using one word in my two-word shop title (their client's shop name is also two words)... they say that it will be confusing to their customers, even though we do not sell the same items at all.  I can't believe that this is accurate since there are 10 active trademarks contai...

I have a registered business name trademark but have been seeing a lot of companies with similar...yet not exact names. Enough that it has the potential to affect an online search.

I have three questions. For privacy sake...pretend my registered name is Bella Bambino Clothing.

1. Someone started a line called La Bella Bambino Clothing. Same service, same product. Does one word make a difference or do they have enough of a  "confusingly similar" nam...

This is probably a really simple question, so please excuse my ignorance.  Here's the hypothetical:

A party starts a consulting business that specializes in teaching people how to use a trademarked web 2.0 software package (say "YouTube" for the purposes of this hypothetical) to market their online businesses.  They name their business "Easy YouTube" and register the domain name "EasyYouTube.com" from which they conduct all of their onli...

Hi, I'm new here and need some advice.

I have a corporation that was established in 2002 operating in KS and MO in the KC Metro area. A company with the same name operating locally in a different state (there are many of us with the same name in different states) registered a trademark for the name (same as mine and many others) a couple weeks ago and had a lawyer send a cease and desist letter saying I was going to be sued for trademark infringement.

Is this legal?...

This may seem a bit silly to some, but I am planning to make a business within an existing online MMORPG (Massively Multiplayer Online Role Playing Game). It will be a completely non profit business in the sense that it will only operate on game currency. I will hire players in the game to work and pay them with game currency as well. All products sold will be ingame products. The only thing I want that separates it from a virtual business within a game is a website. Tons of people play the g...

I have a quick question.  I have a name for a cycle tour company I intend to start in England.  The name is great, but it is already used by a bike shop in Canada.  There is no geographical or business overlap in what each company does, and the domain name I want is available.  However, is this legal to do, or could I be sued by the Canadians?  I do not know how to check if they have registered this as a trademark under Canadian law?  If they haven't, does this a...

In Can I Trademark it?    -  updated on 11/11/2009
Hello,

My wife just started a jewelry design and manufacture business. Her name is also the business' name (just like "HARRY WINSTON", "ERICA COURTNEY", etc.).

She has two logos she uses, one is just the name, in her special font, and the other is the name + a drawing.

The name is stamped on each and every one of the jewelry pieces she makes.

And now to my questions...

1. I would like to register a trademark to protect her business. Do I ...

I would like to trademark the name of my business, and was attempting to file through legalzoom.com. My company will be designing pet playhouses, toys and products.

Basically at this point I just want to trademark the company name, but legalzoom.com have contacted me and are telling me that in order to be protected, I need to pay additional fees for each type of product I'll be selling, if they fall into different classes of goods.

This is all new to me, and I'm quite confused -...

My partner and I recently started a new venture in the United States, and we have a great name for it and started branding all of our products with the name.  We did do due diligence in checking to make sure the name was unique.  One day, just to see if anything from our own website was coming up in Google, we typed in our name and a few resumes popped up with the same company name as ours!  Upon further research we discovered that this company was once located in Australia, an...

In Someone is copying my Trademark, what do I do?    -  updated on 11/11/2009
I own a trademark that is registered.  Another party has since begun using the identical trademark on the same goods.  They have had more success than me.  I have only sold a minimum amount but continue to sell online and in a small number of stores.  Is my small size a factor in me protecting my trademark rights?

Thanks.

Using a common word for a business name - Trouble?

In Can I Trademark it?    -  updated on 11/11/2009
Hi!

I am in the process of coming up with a name for a small company. Right now, we are considering going with a very common word for the name. A good example would be "Circus" or maybe "Picnic".

This single word was available as a corporation and DBA name in my state, and we have already reserved it in case we decide to move on it. I had the trademark division search for the word and apparantly only one pulled up, similar to "Horse & Picnic".

Hello.
Recently I was made aware of the fact that a new website has just opened using the same DBA name as we are. Neither of us have brick and mortar stores..only online. They are selling the same products as we do.
Of course the web URL is slightly different as they added the word "The" to their URL and we've added the word "Online" to ours. But our true DBA name is the same! We have been using this name online for over a year now. I did extensive research (didn'...
