If you recently applied for a car title loan, within or outside of the state of Florida, and the company providing the loan was eTitle Loan, or any company owned by Whetstone Partners, LLC, chances are that you may be a victim of fraud, tortious conduct, and/or forced insurance in the form of “Debt Cancellation Insurance.” It seems that the MO of this company is to use a Tablet to have the trusting client sign a contract that they are never shown. The client is told to click on certain parts, delineated on the Tablet, all while the Whetstone agent purportedly advises you as to what you are agreeing with and that everything he is representing will “later” be delivered to the client (actual contract) by email. They assure you that the same terms were on the contract as was being discussed verbally, they fail to disclose that every time you click on the tablet you are actually signing a contract electronically, a contract that has never been revealed to you! The very moment you call Whetstone, they already calculate Debt Cancellation Insurance into the monthly payment; they never ask you if you have property damage insurance, as it seems that forced insurance is the real money maker of this organized scheme to defraud. If you have been victimized by this company, we will soon provide steps you can and should take towards protecting yourself and others that may, sooner than later, be victimized by this organized fraud operating with impunity within many states. Their license can be pulled in an instant, as they are in violation of many state and federal laws, and their arbitration agreements will not hold in court, as their “arbitration clause” is void and unenforceable, if obtained by fraud “in the inception”; in other words, if you were deceived as to the nature of the act you were performing when you clicked on that tablet, that you could not read, then there is no valid and enforceable contract! We attempted to negotiate with this arrogant company to no avail. If you have been victimized, in the state of FL, you will soon have help, as we are using a consumer activist legal network to get their license revoked. As for immediate action, you should start by notifying the consumer protection services of the FL AG;s office, you can file a complaint online at: http://myfloridalegal.com/Contact.nsf/Contact?OpenForm&Section=Consumer_Protection_Division You can also file a complaint with the federal Consumer Protection Financial Bureau at: https://help.consumerfinance.gov/ You should also file with the Financial regulations office of your state, in FL you can file at: http://www.flofr.com/StaticPages/FileAComplaint.htm We will soon be listing the attorneys name here and the contact info, stay tuned for we will not stop until these criminals are brought to justice! Also, if you are an elederly and was victimized by this economic crime, then you should also contact your local Sheriffs office and file a criminal complaint for the issues that were committed against your particular case... such as fraud on the inception; forced insurance; contract fraud; and economic crimes on the elderly.

Do Not use this company. They are unprofessional and will not apply your payments properly. Also, you cannot get anyone on the phone at this company after your deal is done. Please learn from my very expensive mistake and check this company, also know as (E-Title Loan) out with the Better Business Bureau. Their rating is an F . Their so-called no pre-payment penalty is not true. This company is not trust worthy. Do not get a loan from them.

I took out an auto title loan from Whetstone Partners, LLC in January, 2012. When I took out the loan I was advised by a loan rep that because I don't prepay my auto insurance for at least six months I would need to agree to have a debt cancellation fee added to my contract. I was told that in case of a total vehicle loss this would ensure that Whetstone Partners would get their money. I agreed and I received the money. In September, 2012 I refinanced the loan and again signed a new contract, this time over the phone via Smart Sign. And again I was told I had to have the debt cancellation fee added to my contract in the amount of $1200 payable over the life of the loan which was twelve months. In November, 2012 my car was declared a total loss by my insurance company and Whetstone Partners received a check and were paid in full. They received $4680-which included the amount of the loan plus the debt cancellation fee. After rereading my contract I signed with Whetstone Partners the paragraph pertaining to the debt cancellation fee clearly states that this insurance is voluntary and is not required to do business with this company. It also states that this debt cancellation fee can be cancelled within thirty days of signing the contract. I was never informed that this fee was voluntary and that I could have cancelled it.

***FRAUD***I called Whetstone Partners in December 2011 and inquired on an automobile title loan in the amount of $1,000.00. I was very specific in asking how much money the payoff would be and if there would be any additional fees for paying the loan off early since I intended to pay the balance off in January 2012. I was advised that there are no pre-payment penalties and I would only be responsible for the interest up until the date that I paid off the loan, which should run approximately $1,100. On December 6th 2011, an agent from the company came to my house and inspected my vehicle. At that time he asked me for proof that my automobile insurance is paid up for the next six months. I advised him that it was and attempted to give him my insurance contact information. He advised me that the contact information is not sufficient and if I did not have any documentation with me then I would be charged an additional 37.00 a month. Additionally, I inquired with the agent what the payoff would be since I planned on paying the loan back the next month. I was advised that I would be responsible for the interest, the principle, and the extra $37.00 for not showing proof that my automobile insurance was paid up for 6 months. I agreed to the terms. He then pulled out a tablet and asked me to sign it. I advised him that I could not read the contract on the tablet and could not see what I was signing. He assured me that the same terms were on the contract as we had discussed orally. I then signed the contract electronically. On January 25, 2012 I called Whetstone Partners to pay off my loan balance and was advised that I was charged $450.00 up front for an extra insurance, not the monthly $37.00 that I agreed to. I advised the rep, Linda, that was not what I agreed to and requested to speak with a manager. She then handed the phone to a manager, who did not provide her name to me, who advised me it was my own fault and that's "what I get" for not reading the contract. I then asked her to transfer me to someone else who could assist me. She advised me there was nobody else I could talk to. I asked her for the owner's contact information and she told me his name is Scott Crocket, but refused to give me any contact information. Had the $450.00 fee been disclosed to me, I never would have agreed to borrow $1,000 knowing that I would have to pay back over $600.00 in fees and interest for less than two months. The agents lied to me about the terms of the contract and deliberately withheld a legible copy of the contract to hide the fact that they were charging me an extra $450.00.
