Description of Design Search

The mark consists of a three dimensional configuration of a can. Two dark green strips encircle the side of the can just below the top of the can and are claimed as a feature of the mark. A circular stylized wave design featuring seagulls appears on the upper front of the can underneath the two dark green strips and is also claimed as a feature of the mark. The circular wave design features three waves of increasing size from back to front. Two seagulls appear to the right of the middle wave. The circular wave design is black and gray in color. The two seagulls are black in color. The circular wave design is partially surrounded by a black curved line in an overall semi-circular shape claimed as a feature of the mark. A stylized two-toned splash design in the colors light green and dark green appears on the lower front of the can underneath the circular wave design and curved line and is claimed as a feature of the mark. The white background showing through the mark, including through the circular wave design, is not claimed as a feature of the mark. The additional view of the mark shown consists of a view of the top of the can featuring a pull tab. The color dark green applied to the surface of the pull tab is claimed as a feature of the mark. The second dark green strip encircling the side of the can be seen from the top of the can due to the slope of the can, and thus, appears on the additional view of the mark. The can features two total dark green strips claimed as a feature of the mark. The shape of the can and the pull tab appearing in broken lines are not claimed as features of the mark and are shown only to indicate positioning of the mark.
