When do trademarks expire?
Trademarks can potentially last indefinitely, but they do require periodic maintenance to remain in force.
In the United States, a registered trademark initially lasts for ten years from the date of registration. However, between the fifth and sixth year after registration, you must file a Declaration of Use (Section 8 affidavit) to confirm that the trademark is still in use.
To renew the trademark, you need to file a Combined Declaration of Use and Application for Renewal (Sections 8 and 9) between the ninth and tenth year after registration, and every ten years thereafter.
As long as these maintenance filings are completed and the trademark remains in use, the trademark can continue to be renewed indefinitely.
