Frequently Asked Questions

How long does a trademark last?

In the United States, a registered trademark initially lasts for ten years from the date of registration.

However, to maintain the trademark, you must file a Declaration of Use (Section 8 affidavit) between the fifth and sixth year after the registration date, affirming that the trademark is still in use.

Additionally, you need to file a Combined Declaration of Use and Application for Renewal (Sections 8 and 9) between the ninth and tenth year, and every ten years thereafter.

As long as these filings are submitted and the trademark remains in use, the trademark can last indefinitely.

Using services like Trademarkia can help you manage these renewals and maintain your trademark rights effectively.
