What is a design patent?

A design patent is a type of patent that protects the unique visual qualities of a manufactured item. Unlike utility patents, which cover functional aspects of an invention, design patents protect the ornamental design, shape, or appearance of an item.

This includes the design of everyday objects, furniture, jewelry, and even computer icons. A design patent grants the inventor exclusive rights to the aesthetic design of their product for 15 years from the date of grant in the United States.

This protection prevents others from making, using, or selling a product with a design that is substantially similar to the patented design.
