I am wanting to use SaBro for my Social Media Marketing. I just learned of a beer company that is using Sabro, without the capital B, as the trademarked name for their Hops. Am I able to still use this as it is entirely different market and there is a slight difference with the capitalization?

I have a registered trademark..let's say it is "bagelman"..I have had this for a few years now. Recently I discovered another company is using the name "thebagelman". We even use on our website and advertising a catch phrase and they have almost copied this to the word. We only have TM on phrase. Is this person infringing? Can and should I go after them?
