I own the trademark for Nate Champion class 35 service mark. Nate Champion is a famous cowboy in Wyoming. Just recently a rock band has named their band after the same Nate Champion. Where is my jurisdiction for my mark? Can they sell merchandise at their shows with my Nate Champion on it? Are they infringing? It is the same Nate Champion as my mark.

I've always read that in general, tshirt phrases cannot be trademarked. However in the last couple years I've seen a lot of people taking commonly used popular phrases (or parts of them) and the filing trademarks. In many cases the trademarks are approved. Most of the time the person filing the trademark is not the originator of the phrase (they are just being opportunistic), they are not using the phrase as a real brand, and thousands of products already using the phrases are for sale by man...

I run a private cooking business and have for over 10 years. Someone else who sells a product has chosen my business name and trademarked it. I don't need to trade mark myself, I just want to avoid any legal repercussions, as they have asked me to cease using my name.

Hi. I have not released the app yet but have spent money in terms of design, marketing, logo, etc.,... And unfortunately I found out that the name is already trademarked by another company. The company is in a completely different industry and has no relevance to my app. The company specializes in "Cases for eyeglasses and sunglasses" while my app specializes in mobile social networks. Is it safe to continue using the name? Or should I change it now despite my investment? Thanks, Semih

I have been threatened with legal action the name of what I promote and sell on the internet infringes on a trademark of a large company. Since I know little about trademark laws, I disengaged my websie but retain ownership of the domain. I fear that I may lose a law suit. The company in question now wants ownership of my domain among other things. Is ownership of a domain an infringement if there is nothing back it up?
