Can I trademark a brand used for Print-On-Demand Merchandise?

In Can I Trademark it?    -  updated on 8/23/2017
I want to trademark a brand I use for "print on demand" merchandise sold on sites like Amazon and Redbubble. For example, I create a t-shirt design and upload the design to Amazon, and it is listed for sale. When someone orders the shirt, Amazon (or Redbubble, etc) prints the shirt and sells it. In this scenario, am I considered to be selling goods (tshirts), or services (the designs)? I don't actually own, print, or ever touch the tshirt.

I would like to trademark a name that is already trademarked, but it is in a completely different economic market than what we are in. The current trademark is in the computer software market and we are in the children's clothing market.

I have terminated the services of a company that has been providing administrative and sales services for a software program I developed. They continue to bill users, but are not able to provide support (I am the one with the intellectual property and knowledge to support users) or updates since no one there knows or understands the program. How can I stop them for continuing to bill for services they neither can nor will provide?
