The U.S. Standard Trademark Search

In the U.S. Standard Search Package, you receive a Trademark Search Report prepared after conducting a trademark search of all U.S. federal trademarks using the U.S. Patent and Trademark office's records of registered, published, and pending trademarks. This includes records of cancellations, assignments, and abandonments, where applicable.

A trademark search is an important step to take before you file a trademark application with the U.S. Patent and Trademark Office. A search for U.S. federal trademarks can reveal whether there is already a pending or registered trademark that is identical or very similar to your proposed trademark. If such a trademark exists, a search helps you save time and money you would have otherwise spent on filing a trademark application for your proposed mark which has a low chance of being registered. Our search process uncovers trademarks that are identical and very similar to yours, including those with different spellings, phonetic similarities, and similar meanings.

Marks that have not been registered with the U.S. Patent and Trademark Office but are used in commerce may also receive protection under common law. While they do not directly affect approval of a proposed trademark's application, they may still prevent a proposed trademark from being registered. This can happen, for example, if the owner of a common law mark opposes registration of a proposed mark during the application examination process. As such, a search of common law marks is also beneficial.
