I am considering initiating my first opposition proceeding.  Here's the situation.  An ITU application for the confusingly similar mark whose registration I opppose was actually filed before mine.  Hence, we don't have a registration yet.  However, our use clearly predates use of the other mark (considering it is an ITU app).  So far from my initial research I have gleaned that most oppositions are initiated by one who has an existing registration......

Party A - filed an intent to use TM application on 1-30-07
Party A - Has a State TM approval on 2-9-07
Party A - is in the Notice of publication process
Party B - filed a use based application on 3-23-07 stating used in commerce on 1-23-07
Party B - application is suspended by USPTO "action on this application is suspended pending the disposition of Party A application"

Does this mean party A will not prevail because of party B stating use of commerce 1 week prior...

I am in the process of starting a new non profit youth baseball team.  It is not uncommon for teams to use professional baseball logos on their jerseys that they get made at the local sports store, or order online.  

Is it infringment to use these logos, or does the nature of the use make it legal.  For example a team like the new york yankees could be the southern new york yankees.  We wouldn't claim to actually own the rights to the yankees, just wear the jerseys....

I see that a mark I have applied for is used by a company that is based abroad and whose activity is abroad but claims to have customers in the US and has a website which can be viewed in the US where a use of the mark is displayed.

This company also has a US subsidiary, which looks to me like nothing more than a mailing address. Interestingly, the subsidiary does not use the mark on its separate web page.

Would any of these factors mitigate the claim on the part of this compan...

Hello,

I'm thinking about registering a trade mark with the state instead of going Federal.

I don't really care if someone down the road uses the same business name. However, I don't want to be forced to stop using the name by someone who registers with the feds later.

My entire business platform is Inernet, stll it will be based, registered and trademarked out of one state. Would that not protect me from someone stopping me from using the name later?

Here is my situation. I want to put together a 12 month calendar with BMW M3's in it. I am a member of a forum where M3 enthusiasts hang out and trade tech info and show off their car. I want to use 12 pictures of 12 of the
best cars submitted to me by members of the forum. I do have permission to use the photos and so I have that end covered.

Now my question is whether I am breaking any copyright or TM laws with BMW?
More than likely, you will be able to see the BMW logo and/or ...

Hi I am removing lead based painted kitchen cabinets. How are these cabinets supposed to be treated? Do I break them down and put them in plastic? Our youth football league recieved a letter from the Little League Baseball saying we could not use the words ''little league'' in the name of our football league. Our organization has been incorperated snce 1979,and have used the same name since then. My question is can Little League Baseball stop us from using the words ''little league in our name.
