Description of Design Search

The mark consists of a three-dimensional configuration of a bottle, with a front, rear and side view of product packaging trade dress of a wine bottle. On the front face of the product packaging is a shaded light gray oval label with a border of alternating four dark gray lines and three white lines. The dark gray words "EST. 1942" appear on the front label with a stylized dark gray palace in between the terms. The white wording "MATEUS" appears below the stylized house. The bottle neck consists of a light gray shaded cap at the top of the bottle, extending into the neck of the bottle. At the bottom of the neck portion of the bottle, there is a solid white shaded band with a black line above and below which bisects the light gray neck of the bottle. On the rear side of the product packaging is a light gray shaded oval with the stylized word "MATEUS" in white at the top. There is a white shaded rectangular box at the bottom of the oval. From the side profiles of the bottle, the aforementioned light gray oval shapes and bottle neck and cap are visible. The color amber appearing in the bottle design is intended to depict liquid within the bottle, and is not a part of the mark. The broken lines indicate placement of the mark on the goods and are not claimed as part of the mark.
