T-Shirt Slogans

Can you trademark a basic slogan like:

Yankee Hater
Yankees Suck

I have a company that sent me a cease and desist for a similar slogan and I don't think I need to comply.  

THe slogan is not a tagline they use on their goods or distiguishes their products.  They also sent me another cease and desist for another slogan that is very generic.

Do they have any real legal recourse?  They did file the trademark with the state but anyone can do that for $50 is what I understand..
